Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PDFMakerAPI (“PDFMakerAPI,” “we,” “us,” or “our”), including our website at https://pdfmakerapi.com, the PDF generation API, the Model Context Protocol (MCP) server, and any related tools or integrations (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
PDFMakerAPI lets you and AI agents generate documents and PDFs from templates or plain-language descriptions, and create shareable links to those documents. Some Services are provided without an account or authentication. We may add, change, or remove features at any time.
2. Eligibility
You must be at least 13 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Your Content
“Your Content” means the document data, text, and other materials you (or an AI agent acting for you) submit to the Services. You retain ownership of Your Content. You grant us a limited license to host, process, store, and render Your Content solely to provide and improve the Services. You are solely responsible for Your Content and for ensuring you have the rights to use it and that it does not violate these Terms or any law.
4. Shared Documents Are Public
When you create a shareable document link, that document is accessible to anyone who has the link. Do not put confidential, sensitive, or personal information you do not want others to access into a shared document. We are not responsible for content made accessible through shared links.
5. Acceptable Use
You agree not to use the Services to:
- break the law or infringe others’ rights (including intellectual property or privacy);
- create fraudulent, deceptive, counterfeit, or impersonating documents;
- generate or distribute malicious, harmful, harassing, or unlawful content;
- abuse, overload, disrupt, or attempt to gain unauthorized access to the Services or their infrastructure;
- resell or commercially exploit the Services except as we expressly permit; or
- circumvent rate limits, security measures, or usage controls.
6. Service Availability
The Services may be offered free of charge and are provided on an “as available” basis without any service-level commitment or guarantee of uptime. We may modify, suspend, rate-limit, or discontinue the Services (or any part of them, including shared documents) at any time, with or without notice.
7. Intellectual Property
The Services, including our software, designs, and trademarks, are owned by PDFMakerAPI and protected by law. Except for Your Content, nothing in these Terms transfers any ownership to you. Our open-source components are licensed under their respective licenses.
8. Third-Party Services
The Services may rely on or integrate with third parties (for example, hosting providers and AI platforms). Your use of those third parties may be subject to their own terms, and we are not responsible for them. See our Privacy Policy for how data is handled.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, error-free, or that generated documents will be accurate or fit for any particular purpose. You are responsible for reviewing any document before relying on it.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PDFMAKERAPI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE PRIOR 12 MONTHS, OR (b) USD $50.
11. Indemnification
You agree to indemnify and hold harmless PDFMakerAPI from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content or your use of the Services in violation of these Terms or applicable law.
12. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or to protect the Services or others. You may stop using the Services at any time. Sections that by their nature should survive termination (including Sections 3, 7, 9, 10, and 11) will survive.
13. Changes to These Terms
We may update these Terms from time to time. We will revise the “Last updated” date above, and material changes may be communicated through the Services. Your continued use after an update means you accept the revised Terms.
14. Governing Law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
